PRIVACY POLICY

Privacy Policy is a policy that describes how KB Fina Joint Stock Company (“KB FINA”) collects, receives, aggregates, storages, uses, processes, discloses, shares Customer Information (as defined below) and ensures security of Customer Information when Customer (as defined below) uses KB FINA Service (as defined below) on KB FINA Application (as defined below). By downloading, installing and using the KB FINA Application provided by KB FINA, the Customer hereby acknowledges that it has read, understood, accepted and agreed to abide by this Privacy Policy and any amendments and/or additions with this Privacy Policy, as has announced from time to time on KB FINA's website and/or all medias, tools, applications, and services related to provision of KB FINA Service. The Customer's continued use of the KB FINA Application after that time will be deemed the Customer's consent to the changes to the newly updated Privacy Policy.

 

  1. DEFINITIONS

In this Privacy Policy, the following words and terms shall have the following meanings:

1.1. “KB FINA Application” means an application owned and operated by KB FINA, intended for Customers on mobile devices to use KB FINA Service.

1.2. “KB FINA Account” means the account that the Customer has registered to use KB FINA Service on the KB FINA Application. 

1.3.  “KB FINA Service” means any and all services of KB FINA and/or other linked services of KB FINA's partners, as provided by KB FINA time to time.

1.4. “Customer” means an individual or organization registered to use the KB FINA Service as provided by KB FINA. 

1.5. “Customer Information” means any information and data provided and shared by the Customer during the use of KB FINA Service on the KB FINA Application, has been collected, received, aggregated and kept, used, processed, disclosed, shared by KB FINA, including but not limited to the following information and data: (i) For individuals: name, date of birth, nationality, ID/citizen identification, phone number, email, marriage status, photo, biometric data and other information as required and/or permitted by law; (ii) For organizations: enterprise code or establishment license number, date of establishment, information related to the legal representative, other information as required and/or permitted by law; (iii) Other information: bank account information, transaction information, access history, customer journey and other information as required and/or permitted by law.

 

  1. PURPOSE OF COLLECTING CUSTOMER INFORMATION

KB FINA will collect and use Customer Information for the following purposes:

  1. Verify Customer's information and KB FINA Account;
  2. Review and process requests/transactions; send notices about the Customer's transactions;
  3. Provide the suitable interface, service and report
  4. Choose suitable customers and provide suitable services
  5. Support lock/unclock account
  6. Counting step: paying rewards points according to the number of steps, exchanging reward points for phone cards, balance in e-wallet.
  7. Organize promotional activities, introduction, survey, market research, measurement and evaluation of effectiveness to improve and enhance service quality and content;
  8. Enhance security for Customer's KB FINA Account;
  9. Perform the obligations of KB FINA as committed to the Customer;
  10. Serve internal management purposes such as auditing, data analysis, and database storage;
  11. Detecting, preventing and prosecuting crimes
  12. Help KB FINA comply with other obligations as required by law.
  13. Other necessary cases in the process of using the service

 

  1. INFORMATION AND METHOD OF CUSTOMER INFORMATION COLLECTION

3.1 Information collected

The information you may provide to us includes:

  • Phone number
  • Residential addresses, email address
  • Name of financial institution/Account number/Account name
  • Phone recharge card information
  • Credit Score

Also when our services are used, or our application/website is active, the following personal data may be collected:

  • Phone device model, phone device manufacturer, OS version, carrier, device serial number
  • Access IP address, cookies, ADID
  • Usage data on the application (using features on the application such as accessing the screen/menu, selecting buttons, errors arising during use)
  • Version of the application, time of last access, date of consent to receive advertising information, country, language, area code
  • Physical activity information, total steps, step type (walking/jogging/up and down stairs), distance traveled, walking speed, calories burned, steps, summary information turn off exercise..
  • Status information (KB FINA application usage history, user's online activity information can be captured and analyzed about the customer's interest, favorite, tastes, trends, etc.. row)

3.2 Methods of information collection

KB FINA will collect Customer Information through the following methods:

  1. Customer Information that the Customer directly provides to KB FINA when opening a KB FINA Account;
  2. KB FINA may also collect Customer Information from various sources such as:
  1. Customer fills out registration or applications or other similar forms during the use of KB FINA Application;
  2. Customer provides Customer Information for linking Customer’s bank account with KB FINA Application and services provided by third parties or link to websites and applications of third parties;
  3. Customer interacts and communicates with KB FINA at any event or activity;
  4. Customer participates in contests organized by KB FINA;
  5. Customer uses KB FINA’s websites, including all websites operated by KB FINA and under KB FINA’s respective brand names; 
  6. Customers use new services
  7. From other publicly available sources.

 

  1. SHARE CUSTOMER INFORMATION WITH THIRD PARTY

4.1. The Customer hereby unanimously agrees to allow KB FINA to provide Customer Information to the following third parties to serve the Customer's use of KB Fina Service on the KB FINA Application:

  1. KB FINA’s partners, including KB FINA’s partners collaborating as information technology (IT) service providers for infrastructure, software, and development mission, mobile recharge, Telecom operators (Viettel, Vinaphone, Mobiphone, Vietnammobile, Gtel), other business partners of KB FINA related with the Customer's use of features on the KB FINA Application;
  2. Staffs, professional advisors and external auditors, including legal counsels, financial advisors and consultants of KB FINA;
  3. Competent state agencies as required by law
  4. Other subjects as required by law.

4.2. The KB FINA Application may contain services provided by third parties or link to websites and applications of third parties. By agreeing to use the services and provide information to such third parties, the Customer hereby understands and agrees that:

  1. KB FINA is not responsible for the collection, use, maintenance, sharing, or disclose of Customer's data and information to such third parties; and
  2. The privacy policies and terms of use of such websites and applications will apply when Customer uses third-party services.

 

  1. CUSTOMER INFORMATION SECURITY

KB FINA commits to keep Customer Information in private, does not provide or disclose to any party any Customer Information without the consent of the Customer, except for the cases specified in Article 4 of this Privacy Policy and/or other cases as prescribed by law.

KB FINA keeps and secures Customer Information at system servers, cloud storage systems were committed of security according to KB FINA standards. However, please note that although KB FINA takes reasonable measures to protect Customer Information, no website, Internet transmission, computer system, or wireless connection is completely secured.  KB FINA cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur.

 

  1. DURATION OF RETENTION OF CUSTOMER INFORMATION

KB FINA takes appropriate steps to ensure that KB FINA processes and retains Customer Information in accordance with the following principles: 

  1. At least for the duration for which the Customer Information is used to provide the Customer with KB FINA Service; and
  2. Only for as long as it is necessary for the purpose for which it was collected, is processed, or longer if required under any contract, by applicable law, or, in anonymized form, for statistical purposes, subject to appropriate safeguards. 
  3. Until the process is completed to receive the corresponding service provision (corresponding storage time in case information needs to be stored according to relevant laws)

In case the Customer closes their KB FINA Account, KB FINA will proceed to close that KB FINA Account but may still retain the Customer Information for a certain period of time in order to serve the arrears debt, dispute resolution, troubleshooting, investigation assistance, risk prevention, compliance with this Privacy Policy and Terms of Use, combating illegal acts and/or requirement of law.

 

  1. CUSTOMER'S RIGHTS TO ACCESS, EDIT INFORMATION

To the extent required by law, the Customer is entitled to ask KB FINA for a copy of the Customer Information that KB FINA has collected, and the Customer can ask KB FINA to delete any Customer Information or correct/update any in accuracies by emailing cs@kbfina.com.vn in the following circumstances:

  • You believe that these personal data is no longer necessary for us to hold your personal data.
  • We process your Personal Data that we have collected with your permission and you wish to revoke your permission and there is no other basis for us to process this Personal Data.
  • You no longer want us to continue to use your Personal Data collected by us to submit advertisements, special recommendations, sales programs and lucky programs.
  • You believe that your Personal Data collected by us is unlawfully processed by us.

Please provide as much detail as possible your reasons for assisting us in determining whether you have reasonable grounds to request data deletion. However, we may retain Personal Data if there is a legitimate basis in accordance with the law for us to do this, however we will notify you of these cases. Please note that after deleting Personal Data, we may not be able to provide the same information anymore.  

The Customer also has the right to correct or update their information by themselves at any time by accessing the Customer's KB FINA Account and making adjustments.

The Customer can choose to stop receiving promotional communications to emails from KB FINA by clicking “unsubscribe” link in the email received. The Customer can also choose to stop receiving KB FINA notifications on KB FINA Application by customizing permissions in access device according to regulation of mobile platforms (iOS, Android, etc).
